Article I. Privacy Policy

Walnut recognizes the importance of protecting the privacy of all information provided by users of the Walnut services, products and/or website(s) (collectively, the "Site(s)").  We created the following policy guidelines with a fundamental respect for our customers and other users'(collectively, "users" or "you") right to privacy to guide our relationships with our users.  This Privacy Policy applies to these Site(s) and explains how Walnut-and its affiliates (collectively, “Walnut”, "we" or "us") collects your personal or business information, how we handle, make use of and/or protect this information and what you can do to help protect this information.  By using these Site(s), you consent to the information, data and other practices described in this Privacy Policy.  We may change this Privacy Policy from time to time to more accurately reflect how we gather, manage and/or use your information.  All changes to this Privacy Policy are effective upon our publicly posting any such change or revised Privacy Policy to a Walnut website.  Walnut encourages you to check the Walnut website(s) page regularly.  Your continued use of any of these Walnut Site(s) following the posting of changes or revised Privacy Policy constitutes your agreement to this Privacy Policy and any revisions thereof.  This Policy is incorporated into, and part of, the Walnut Terms & Conditions, which govern your use of these Site(s) in general. 


Article II. Collection Of Your Information

Walnut may collect personally identifiable information, such as your name, business name, address, email address, telephone number and products and/or service preferences, experiences or desires.  We may gather additional personal or non-personal information pertaining to you in the future.  Walnut only collects personal and business information that you voluntarily provide to us, such as when you request information or support, as well as your information which may be involved in any of our products and/or services.

Anonymous information is collected for every visitor to these Site(s).  This includes data regarding web pages viewed, date and time viewed, referring website domain, and browser type.  IP addresses may also be stored; and may be used to determine domain type and in some cases, geographic region and other information of the user.  

IP addresses are also used by computers on the network to send the requested pages to users or customize the user’s experience.  In order to access certain portions of our Site(s), you must register and provide certain voluntary information, including your name, address, and e-mail address.


Article III. Use Of Your Information

Walnut collects and uses your personal information to operate the Site and deliver the products and/or services you have requested, as well as to suggested additional products and/or services and to promote Walnuts products and/or services.  Walnut may share data with trusted partners to help perform statistical analysis and other business analytics and programs, send you email or postal mail, provide customer support or suggestions, and/or arrange for deliveries or other services.  Walnut may supply your information to our service contractors and sub-contractors, distributors and/or dealers covering your region, and other applicable third parties.  Walnut uses reasonable precautions to keep secure any personal information disclosed to us. 

Using e-mail addresses provided at registration on or with respect to any Walnut Site, product and/or service, or otherwise, Walnut may periodically send e-mail newsletters to users about services and products offered by Walnut, its affiliates and/or its and their business partners and associates.  Users can, at any time, indicate to Walnut that they do not wish to receive e-mail information from Walnut by updating the user’s email preferences or unsubscribing from all future emails. 

If Walnut is required by law or legal process or otherwise deems it necessary, desirable or appropriate, Walnut may disclose or provide access to your information to such government or judicial authority or other applicable party as specified by such law or legal process or other applicable request.  We may also share information when we have a good faith belief it is necessary to prevent fraud or other illegal activity, to prevent imminent bodily harm, to enforce Walnut’s license agreements or other agreements, or to protect ourselves, or affiliates, business partners and associates and/or you from people breaching or violating this Privacy Policy or any other Walnut or a Walnut affiliate, business partner or associate agreement, arrangement, or understanding.

While we try to link only to sites that share our high standards and respect for privacy, we are not responsible for the content or the privacy practices employed by other sites.  The Site(s) may contain links to third party sites.  This Privacy Policy applies only to Walnut and its affiliates and not to other companies' or organizations' websites to which we may link.  We are not responsible for the content or the privacy practices employed by other websites.  We urge you to review the privacy policy posted on any site you visit before using the site or providing any personal data about yourself.


Article VI. Exclusions

This Privacy Policy does not apply to any information collected by Walnut or its affiliates other than information collected through these Site(s).  This Privacy Policy may not apply to any unsolicited information you provide to Walnut through these Site(s) through comments, product and service reviews or through any other means.  This includes, but is not limited to, content or other information submitted to these Site(s), such as comments, any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, "Unsolicited Information").  All Unsolicited Information shall be deemed to be non-confidential and Walnut shall be free to reproduce, use, disclose, distribute, and exploit such Unsolicited Information without limitation or attribution.


Article VII. Children

Walnut is committed to protecting the privacy of visitors under the age of 18.  If you are the parent or legal guardian of a minor, we may use your personal information to request or obtain parental consent for the minor’s use of these Site(s).  Parents should supervise the online activities of their children, and consider the use of tools available from online and other services and software providers to help provide kid-friendly Internet environments.  These Site(s) are not intended for use by children.  Walnut will not knowingly collect any personal information from visitors to these Site(s) who are under the age of 13.


Article VIII. Assignment/Miscellaneous

Assignment:  If the ownership of all or substantially all of our business changes, of if Walnut is subject to a merger, consolidation, other reorganization or other transaction deemed by Walnut to involve or include any of your information, we may sell, assign, or transfer your information to the new owner or other third parties without restrictions so that these Site(s), services, products, and/or other activity can continue to operate and grow and make use of such information relatively without restriction.  

Security:  We have reasonable and appropriate security measures in place to attempt to protect against the loss, misuses, and alteration of your personally identifiable information under our control.  In all cases, we have taken reasonable steps to confirm the information is retained in secured facilities and that reasonable measures have been implemented for protection from unauthorized access.  All personal information accepted on these Site(s) is encrypted and secure through the use of Secure Sockets Layer (SSL) software.  However, no security system is impenetrable.  We cannot guarantee the security of our Site or databases, nor can we guarantee that information you supply will not be intercepted while being transmitted to us over the Internet.  We ask that you do your part by maintaining the strict confidentiality of any computer passwords you use to access the Internet or these Site(s).

Joint Promotions: From time to time, we may join with third parties to provide specific services or products.  When users sign up for these services or order these products, we will share only the names and other information that is necessary, useful, and/ or desirable for the third parties to provide these services or products.

Article IX. California Privacy Rights
